Lasting Powers of Attorney

If illness, accident or old age mean you can’t look after your own property and financial affairs, it’s essential that those you trust most can take over without expense, hassle and delays. Putting lasting powers of attorney in place is the only way to make sure that happens.

It’s really important to put lasting powers of attorney in place while you’re mentally well and capable, to avoid your loved ones having to go through a long-winded, costly process through the Court of Protection if you lose capacity. I can advise on the benefits of lasting powers of attorney, and I’ll complete and register the powers for you – so you can be secure in the knowledge that everything’s in place.

There are two types of lasting powers of attorney (LPA):

  • Property and financial affairs – this appoints one or more attorneys to deal with your property and finances, either when you ask them to or when you’re unable to yourself, through illness or lack of mental capacity.
  • Health and welfare – this appoints one or more attorneys to make decisions about your day-to-day care when you’re unable to do so yourself through lack of mental capacity. This might also give your attorneys authority to give or refuse consent for life sustaining treatment for you.

The LPA process

We would meet (face to face or online) to discuss your personal situation and what you want to put in place, before confirming costs.

If you choose to go ahead, we’ll draft your LPA documents. We’ll then meet to go through these together. I’ll act as your ‘certificate provider’ to confirm your understanding of the documents, and then witness your signatures.

Finally, we can arrange for the attorneys to sign, and when the document is complete, make the application to the Office of the Public Guardian to register the LPA. LPAs must be registered before they can be used, so it’s best to do this as soon as the documents have been completed.
